By accessing or using dekhval's services, website, or any associated applications (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all users of the Service, including businesses, employees, and any individuals who access or use the platform. By using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. Description of Service

dekhval is an AI-powered business operations platform designed for businesses in Bangladesh. The Service provides:

• AI-powered business operations management via WhatsApp integration
• Automated inventory tracking, order management, and customer communication
• Financial reporting and business analytics
• Customer relationship management through conversational AI
• Integration with existing business workflows and tools

The Service operates primarily through WhatsApp messaging and a web-based dashboard. Features and availability may vary by subscription plan.

3. Subscription Plans & Billing

dekhval offers subscription plans billed in Bangladeshi Taka (BDT). By subscribing, you agree to pay the applicable fees for your selected plan. Plan details, pricing, and features are described on our pricing page.

• Billing cycle: Subscriptions are billed monthly unless otherwise specified.
• Payment: Payment is due at the beginning of each billing cycle.
• Price changes: We may adjust pricing with at least 30 days' notice before your next billing cycle.
• Refunds: Refund requests are evaluated on a case-by-case basis. Contact us within 7 days of a charge if you believe it was made in error.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations in Bangladesh or internationally
• Transmit spam, malware, or any harmful or unauthorized content
• Interfere with the operation of the Service or other users' access
• Attempt to gain unauthorized access to the Service's systems or data
• Use the Service for any fraudulent, deceptive, or illegal purpose
• Reverse-engineer, decompile, or attempt to extract the source code of any part of the Service

We reserve the right to suspend or terminate accounts that violate these guidelines.

5. Intellectual Property

The Service, including its software, design, content, logos, and trademarks, is owned by dekhval and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written consent.

You retain ownership of the data and content you submit through the Service. By using the Service, you grant dekhval a limited license to process your data solely for the purpose of providing and improving the Service.

6. Limitation of Liability

To the maximum extent permitted by law, dekhval and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to dekhval in the twelve (12) months preceding the claim.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Termination

Either party may terminate the use of the Service at any time. You may cancel your subscription by contacting us. We may suspend or terminate your access if you violate these Terms or for any reason with reasonable notice.

Upon termination, your right to use the Service ceases immediately. We will retain your data for a reasonable period to allow you to retrieve it, after which it may be deleted in accordance with our Privacy Policy.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of Bangladesh. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Dhaka, Bangladesh.

9. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the Service or via other communication channels. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
